terms of service

VIREMY Co., Ltd. ( hereinafter referred to as "the Company" ) has established the following Terms of Use ( hereinafter referred to as "these Terms" ) for its " VIRGOwearworks OFFICIAL ONLINE STORE ". Users of this service ( meaning members and guests ) agree to the following matters.   

Membership Regulations  

1. Members 

A member is defined as someone who has accepted these terms and conditions, submitted a membership application by entering the required information on our membership registration form, and whose application has been approved by us.

■ Member Registration  

By using this service, members agree to these terms and conditions.
If you do not agree to these terms and conditions, you cannot use this service.  

Our company reserves the right to refuse member registration if we determine that any of the following circumstances exist, and we shall have no obligation to disclose the reasons for such refusal.   

1. If false information is provided when applying for membership registration. 

2. If the application is from a person who has previously violated these Terms and Conditions.  

3. In any other case where we deem it inappropriate to commence this service.    

■ Usage restrictions and account cancellation  

Our company may , without prior notice , restrict a member's use of all or part of this service , or cancel their registration , in the following cases:  

If you violate any provision of these Terms and Conditions  If it is discovered that there are false facts in the registration information  In addition , if we determine that the use of this service is inappropriate...  Our company shall not be liable for any damages incurred by members or third parties as a result of actions taken by our company pursuant to this article .    

■Cancellation of use/withdrawal  

Members can discontinue using this service at any time.
Members can withdraw from the membership at their own discretion.
Our company has no obligation to retain or return any personal information or other information of members who have withdrawn from our service.  

If a member violates these terms and conditions, or if we determine that the member is unsuitable as a member, we may suspend the provision of services or expel the member without prior notice.
In that case, regardless of the reason, the member shall not be able to challenge it against our company.  

Members are not released from any obligations or liabilities related to the use of this service, even if they lose their membership or discontinue using this service.   

2. Product Information  

While we strive to display accurate product information, in the event of any errors in pricing or other information, we may be unable to accept orders based on that information.

In that case, we will contact the user with the correct information and reconfirm their intention to purchase at the correct price.  

While we strive to display images as accurately as possible, due to PC monitor settings and characteristics, there may be slight color differences compared to the actual product. Users should understand this before placing an order. 

All copyrights, trademarks, design rights, patent rights, utility model rights, and other intellectual property rights relating to this service and its use, including images, designs, and functions, belong to our company or other legitimate rights holders, and users shall not infringe upon these rights.  

3. Repair, Return, and Exchange 

For products purchased at our directly managed stores, we will repair or replace any damage or defects that can be determined to be initial defects free of charge.

For damage not caused by customer negligence, we will inspect the condition and repair or, if necessary, replace the item.
(Please note that shipping and repair costs will be the customer's responsibility.)

Please bring your receipt or proof of purchase when you visit our store.  

■ Returns and Exchanges  

Once your order arrives, please be sure to check within 7 days to ensure that the product is free of scratches or defects and that the contents of your order are correct.  

Additionally, please be sure to keep the "Delivery Slip/Receipt" included with the product, as well as the "Warranty" if one is included. 

If the reason for your return is due to customer reasons such as "the product is different from what I expected," "the size is wrong," or "I made a mistake in my order," we will accept the return if it meets our return conditions.  

In that case, all shipping and handling fees for returns will be the customer's responsibility.   

The following conditions must all be met for a return to be possible.
- Products for which we receive a return request within 7 days of receiving the product.
Products that can be judged as "unused" according to our company standards.
- Products that come with all included accessories, warranty cards, product tags, boxes, etc.
- Products returned within 10 days of arrival.
- Products that do not have "non-returnable" stated on the product page    

We cannot accept returns in the following cases:  ・

- Products that have been received more than 8 days ago
- Sale items, outlet items, and hygiene products that come into contact with the skin, such as underwear, swimwear, and socks, which are clearly marked as "non-returnable" on the product page.
- Products with missing or detached accessories, warranty cards, defect tags, or sales tags.
- Items that have been used, altered, washed, or dry-cleaned.
Products that have acquired odors, stains, or scratches while in the customer's possession; products whose packaging (bags, boxes, etc.) has been lost or damaged.
- Products for which the warranty card or product tag has been lost.  

*For items purchased at stores other than VIZ STORE-TOKYO or other retailers , please contact the store where you purchased the item.    

In addition, this includes defective products caused by the customer's own negligence.  

While intentionally damaging a good product purchased by a customer does not constitute property damage, if a customer intentionally damages a product in an attempt to obtain money by refusing to exchange a defective product for an equivalent good product, or if it is confirmed that a good product has been made defective and damaged, we will take legal action, including guidance from the police, lawyers, and experts.  

In the event that damages are incurred by the user due to reasons attributable to our company in relation to this service, our liability for compensation shall be limited to the price at which the user purchased this product. 

4.Disclaimer 

Except where required by law, our company makes no warranties whatsoever that any information that users may obtain through this service will be suitable for the user's specific purposes, or that it will have the expected specifications, functions, commercial value, accuracy, usefulness, or completeness.  

Except in cases attributable to our company ( including our business partners ) , we shall not be liable for any direct or indirect damages incurred by users or third parties as a result of using this service or the information or content contained herein.  

In the following cases, we may interrupt or suspend this service without prior notice or consent from the user.

We shall not be held liable for any disadvantages or damages incurred by users as a result of the following circumstances.  

This service is used for regular maintenance, updates, and in emergency situations.  In the event that it becomes difficult to provide this service due to force majeure such as fire, power outage, or natural disaster.  In the event that we are unable to continue providing this service due to other unforeseen circumstances,  While our company takes sufficient care to protect personal information entered and transmitted by users when using this service, including encrypting and securely storing and managing it, we cannot guarantee against information leakage, loss, or alteration by third parties. 

Except in cases attributable to our company ( including our business partners ) , we shall not be liable for any damages incurred by users or third parties due to information leaks, loss, alteration by third parties, etc.  

Our company makes no warranties whatsoever regarding the safety, reliability, usefulness, timeliness, legality, morality, or freedom from computer viruses of any information obtained through this service or through emails sent by our company.  

5. Other

If any issues arise regarding the use of this service that cannot be resolved by these terms and conditions, the matter shall be resolved through good-faith discussions between the Company and the user.  In the event that litigation becomes necessary in connection with the use of this service, Japanese law shall apply, and the Tokyo District Court shall be the exclusive court of first instance.
