VIREMY Inc. (hereinafter referred to as "the Company") establishes the terms of use (hereinafter referred to as "these Terms") for "VIRGOwearworks OFFICIAL ONLINE STORE" (hereinafter referred to as "the Service"), which is operated by the Company, as follows.
Users of the Service (including members and guests) shall use the Service after agreeing to these Terms.

 

Article 1 (Membership Registration)

  1. A member is an individual who agrees to these Terms, applies for membership registration through the method specified by the Company, and is approved by the Company.
  2. The Company may not approve membership registration if it determines that any of the following applies. The Company is not obligated to disclose the reasons for such disapproval.
  • If there is false, erroneous, or missing information in the registration details.
  • If the applicant has previously received measures such as suspension of use due to violation of these Terms.
  • If the Company otherwise deems the membership registration to be inappropriate.

Article 2 (Restrictions on Use and Deletion of Registration)

The Company may, in the following cases, restrict the use of the Service or delete membership registration without prior notice.

  • Violation of these Terms.
  • If false information is found in the registered details.
  • If the Company otherwise deems the use of the Service to be inappropriate.

The Company shall not be liable for any damage caused to users or third parties by these measures, except in cases of the Company's willful misconduct or gross negligence.

Article 3 (Withdrawal)

  1. Members can withdraw at any time through the prescribed procedure.
  2. After withdrawal, the Company shall not be obligated to retain personal information, except as required by law.
  3. Obligations already incurred shall not be extinguished even after the loss of membership.

Article 4 (Product Information)

  1. While the Company strives to publish accurate product information, in the event of misprints or pricing errors, it may cancel orders or confirm their content.
  2. Product images are made to be as close to the actual product as possible, but there may be differences in color depending on the viewing environment.

Article 5 (Order Cancellation)

The Service, as a general rule, does not accept order cancellations due to customer convenience, except in cases attributable to the Company, such as initial defects.

Article 6 (Returns and Exchanges)

  1. While we take all possible measures to ensure product quality, returns and exchanges will only be accepted in the following cases:
  • Product damage or defacement
  • Delivery of a product different from the order
  1. Please contact us within 7 days of product arrival.
  2. The Company will bear the shipping costs for return and redelivery.
  3. If an exchange item cannot be provided, a refund will be issued.

Returns and exchanges cannot be accepted in the following cases:

  • If 8 or more days have passed since product arrival
  • Used products
  • Damage, alteration, or repair by the customer
  • Missing accessories

Article 7 (Cooling-off)

As this Service is a mail-order service, the cooling-off system does not apply.

Article 8 (Repairs)

The Company may provide repair services depending on the condition of the product.

Article 9 (Delivery and Redelivery)

  • Products that exceed the storage period will be returned.
  • The shipping cost for returns and redelivery will be borne by the customer.
  • The same applies to prolonged absence or refusal to receive.

※ For orders where cash on delivery was selected, if the product is returned due to prolonged absence, refusal to receive, etc., we may charge round-trip shipping fees and various handling fees.
Furthermore, if multiple returns due to similar reasons are confirmed, we may refuse the use of cash on delivery for future orders.

Article 10 (Prohibited Acts)

The following acts are prohibited:

  • Providing false information
  • Fraudulent orders or returns
  • Fraudulent claims due to intentional damage to products

If a customer intentionally damages a good product they purchased, it does not constitute damage to property. However, if a customer maliciously damages a product intentionally or deceives us to obtain money by refusing to exchange a good product for a product equivalent to a defective one, or if we confirm acts of turning a good product into a defective one by damaging it, we will take legal action and measures under the guidance of our legal counsel, police, and experts.  

The Company's liability for damages incurred by users due to reasons attributable to the Company in connection with this Service shall be limited to the purchase price of the product purchased by the user. 

Article 11 (Intellectual Property Rights)

All content published on this Service belongs to the Company or its rights holders.

Article 12 (Disclaimer)

  1. The Company does not guarantee the completeness or accuracy of the content of this Service.
  2. The Company shall not be liable for any damages arising from the use of this Service, except in cases of the Company's willful misconduct or gross negligence.
  3. The Service may be interrupted due to natural disasters, system failures, etc.

Article 13 (Damages)

Damages for reasons attributable to the Company shall be capped at the purchase price of the relevant product.

Article 14 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law, and any disputes shall be exclusively under the jurisdiction of the Tokyo District Court.

Article 15 (Consultation)

Matters not stipulated in these Terms shall be resolved through consultation between the Company and the user.

 

 

Furthermore, if any act in violation of these Terms or an act deemed inappropriate by the Company is confirmed, the Company may, at its discretion, take measures such as restricting orders or suspending account usage.

 

By placing an order for a product on this online store, the customer is deemed to have fully confirmed and understood the content of these Terms and agreed to them, and a contract based on these Terms shall be formed.
